Real estate litigation
Commercial leases, failed closings, boundary and easement fights, and title problems that ended up in court.
A property dispute is expensive to leave open: a sale can't close, a tenant can't open, a lender won't fund. We look for the quickest route to a clear answer, whether that's a negotiated fix, a quiet title action or a trial.
We represent buyers, sellers, landlords, commercial tenants and neighbors, in commercial and residential matters.
Property disputes we take on
Commercial leases
Defaults, early exits, repair fights and personal guaranties.
Failed closings
A buyer or seller who walked away, and the deposit both sides claim.
Boundaries and easements
Fences, driveways, access roads, and who has the right to use them.
Title disputes
Quiet title actions, clouded titles and deeds signed in doubtful circumstances.
Two property matters, briefly
The deposit follows the contract.
Condo sale · Tampa
A buyer walked away a week before closing and demanded his $40,000 deposit back. The contract's financing deadline had already passed, and our client, the seller, kept the deposit.
Old easements still count.
Driveway access · Jacksonville
A neighbor gated the only driveway to our client's lot. An easement recorded decades earlier settled it, and the court ordered the gate removed.
Sample matters that show the kind of dispute we take and how we work it. Every case turns on its own facts, and past results don't guarantee a similar outcome.
Property dispute questions
The other side won't close. Can a court make them?
Sometimes. A court can order a sale to go through, called specific performance, when the contract and the facts support it. Otherwise the remedy is usually money or the deposit.
My commercial tenant stopped paying. Is this an eviction?
It can be, along with a claim for the rent owed and against any guarantor. Commercial evictions move on their own track, and the notice you send first matters.
Can someone record a lawsuit against my property?
Yes. A notice of a pending lawsuit can be recorded and will cloud the title until the case ends or the notice is removed. We can move quickly to challenge one.

The address, the other party and what's stuck. A lawyer calls back once we've checked for conflicts.
